Terms and conditions

1. Acceptance of Terms

By purchasing or participating in an AviaSim USA flight simulation experience (“Flight”), you agree to be bound by these Terms and Conditions. These Terms apply both to the individual who purchases the reservation (“Purchaser”) and to any individual who participates as the pilot during the Flight, whether or not they made the purchase (“Participant”). All Participants must comply fully with these Terms and Conditions as a condition of entry and participation.

By making a purchase or participating, you acknowledge that you are either of legal age of majority in the state where the Flight takes place or the legal guardian of a minor who will take part in the activity. Minors must be accompanied by an adult at all times during the experience.

2. Validity of Boarding Passes

Boarding passes are valid for 36 months (3 years) from the date of purchase. After this period, they expire and are non-refundable except where prohibited by law. All amounts are in USD.

3. Reservation Modifications or Cancellations

You may modify or cancel your reservation through our booking platform or by contacting customer service at no charge if done at least 48 business hours before your scheduled flight. Within 48 business hours of the scheduled flight, changes can only be made by contacting customer service and will incur a $69 USD fee plus applicable taxes. If you do not show up for your flight, your reservation will be canceled without any refund. All appointment times are in the local time zone of the AviaSim center.

4. Flight Specifics

Flights may only be used at the AviaSim center where they were purchased and are valid only for the package indicated on the boarding pass. A flight may be upgraded before booking the date and time by contacting customer service and paying the difference between the new package price and the original purchase; the upgrade must be completed at least 48 business hours before the appointment.

Boarding passes do not display the purchase price. Boarding passes may be given as a gift to another individual. They are strictly non-transferable between AviaSim centers and may only be redeemed at the center where originally purchased. Boarding passes are non-refundable and will not be replaced if lost or stolen. Resale is prohibited.

5. Identification Requirement and Admission Policy

A valid government-issued photo ID is required upon arrival. If you are unable to provide identification, we reserve the right to deny access to the simulator and cancel your flight without refund.

For safety and security, simulators are equipped with video surveillance used for security purposes only and handled in accordance with applicable U.S. law. Recordings are retained for 30 days and then destroyed, unless retention is required by law. By purchasing and/or participating in an AviaSim flight, you consent to this security surveillance. AviaSim may share footage with legal authorities and law enforcement as required by law.

6. Minimum Age and Physical Requirements

The minimum age is 10 years, with a minimum height requirement of 3’7″ (1.10 m). AviaSim simulators are exact cockpit replicas and require sufficient mobility to enter, exit, and operate safely.

Please note: the simulator environment includes flashing lights/visual effects and confined spaces, which may trigger photosensitive epilepsy, discomfort for individuals with severe claustrophobia, or other conditions. If you have any medical or accessibility concerns, please contact AviaSim prior to purchase to discuss reasonable accommodations. AviaSim will provide accommodations consistent with the Americans with Disabilities Act (ADA) where feasible.

7. Alcohol and Drug Influence

If we reasonably believe you are under the influence of alcohol or controlled substances (whether legal or illegal), access to the simulator will be denied and your flight will be canceled without refund. Food and beverages are prohibited inside the simulator. AviaSim complies with state and federal laws regarding controlled substances.

8. Behavior Policy

Using offensive language or behaving in a disruptive or disrespectful manner with other visitors or staff may lead to termination of the session and expulsion without refund. Staff reserve the sole discretion to immediately terminate the experience without refund in the interest of safety and guest comfort.

9. Late Arrival Policy

If you arrive late for your appointment, your simulator flight time will be reduced by the length of your delay. No-shows are considered late arrivals of more than 15 minutes without prior notice.

AviaSim is not responsible for traffic disruptions, public transportation interruptions, or misinterpretation of appointment times or time zones. If flight time is reduced due to late arrival, requested breaks, motion sickness, or other personal/physical issues, no compensation or refund will be provided.

10. Technical Issues

If technical difficulties occur on the day of your appointment, we may reschedule your experience to a later date without additional compensation. AviaSim will not reimburse travel, lodging, meals, or other incidental or consequential costs associated with a rescheduled or interrupted experience.

If technical difficulties during the session significantly reduce flight time or stop the experience, a form of compensation or rebooking may be offered at AviaSim’s discretion in coordination with customer service.

11. Cooling-Off and Pricing Policy

You have 7 days from receipt of your boarding pass to withdraw from your purchase without penalty and without providing a reason (7-day cooling-off period). After 7 days, all sales are final and flights are non-refundable, except where required by law.

AviaSim may run promotions from time to time; discounts cannot be applied retroactively, and no partial refunds or credits will be granted after purchase.

12. Recreational Use Only

AviaSim centers are intended for recreational activities only and are not certified for pilot training. AviaSim USA is not affiliated with the FAA, and sessions do not count toward pilot certification or logged flight hours.

13. Policy and Availability Changes

Prices, simulator availability, locations, hours, and policies are subject to change at any time in accordance with applicable law.

14. Photography and Video Use Policy

Photos and videos taken by guests are for personal use only. Any commercial use, reuse, or reproduction requires AviaSim’s express written permission. AviaSim reserves the right to restrict or prohibit photography in certain areas for safety, privacy, or intellectual property protection.

By entering AviaSim premises, you grant permission to be photographed or filmed for promotional use, unless you notify us in writing before your session. Content voluntarily posted online and tagged with AviaSim accounts may be reshared by AviaSim with credit to the original poster.

15. Animals

Animals are not allowed. Service animals as defined under the ADA are permitted; emotional support animals and pets are not permitted inside the simulator area.

16. Waiver of Liability and Assumption of Risk

By purchasing and/or participating, you acknowledge that the simulator environment includes flashing lights/visual effects and confined spaces, and requires careful movement within a compact cockpit. You agree to exercise caution to avoid bumps or minor injuries and to immediately inform staff of any discomfort (e.g., photosensitivity, claustrophobia).

To the fullest extent permitted by law, AviaSim shall not be liable for personal injury, property damage, medical episodes, or other losses arising from participation, except in cases of AviaSim’s gross negligence or willful misconduct.

17. Governing Law and Venue

These Terms & Conditions are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Newark, Delaware.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Accessibility (ADA)

AviaSim makes reasonable accommodations consistent with the Americans with Disabilities Act (ADA). Guests with accessibility needs are encouraged to contact AviaSim before purchase or booking to discuss available accommodations.
